All images, logos, graphics, script, code, text, and such are the copyright protected property of Clikphoto. User may not use, transmit, re-post or by any other means utilize any of the above property without the express written consent of Clikphoto.
Usage
of any of the above materials will be deemed as willful and
swift legal action will be taken. Images stolen and
displayed or reposted on the internet or any internet site
will be charged and billed at the "Internet Usage Licensing
Fee" of $2500.00 per image per year. This is the base
value of a copyright protected image as determined by the U.S.
Supreme Court. In cases of copyright infringement we
will seek full punitive damages equal to triple value awards
and all legal fees incurred.
Under
the "Digital Millennium Copyright Act" (DMCA) of 1999 we will
contact the service provider (ISP) of the offending site,
putting them on notice to the allegations of copyright
infringement. The ISP is required by law to remove or
block access to the alleged materials during the investigation
into claims. If the ISP does not take the appropriate
action they will become liable for and a co-party to any and
all legal action taken.
Please
note: Not knowing the laws does not indemnify you from
prosecution! All published materials after 1986 are
covered under U.S. copyright laws and their protection.
There is no "Public Domain" for these materials. They are the
property of the publisher. If other words: "If you don't
own the image or have the owners permission to use it...DO NOT
publish it on your website or the Internet." You will be
legally liable for prosecution.
